Effective Date: February 2026 These Terms of Service govern participation in any auction conducted by Jett Auction. By registering, bidding, or participating in any auction (in-person or online), you agree to be legally bound by these Terms.

Acknowledgment & Acceptance

By participating in any Jett Auction event, you acknowledge that you have read and understood these Terms of Service, accept all rules, fees, and published policies, agree to comply with all procedures outlined herein, understand that all sales are final and binding and that failure to review these Terms does not relieve you of responsibility, and further acknowledge that purchasing vehicles at auction involves inherent risk, that vehicles are typically sold at wholesale pricing without mechanical inspection or certification unless expressly stated in writing, that such vehicles will likely require repairs, maintenance, or reconditioning, that some vehicles may not be roadworthy or suitable for transportation at the time of sale, and that you accept full responsibility for factoring potential defects, repair costs, and unknown conditions into your bidding decisions.

Buyer Responsibilities & Due Diligence

Buyers are solely responsible for conducting independent due diligence before placing a bid. This includes, but is not limited to: Verifying year, make, model, trim, drivetrain, powertrain, features, options, and condition. Reviewing all available CARFAX reports. Inspecting vehicles in person prior to bidding. All vehicles are processed using VIN decoding software and automated data systems. CARFAX reports are scanned by automated programs to extract listing details. While Jett Auction makes CARFAX reports available with each listing, information may contain errors due to data entry issues, third-party reporting inaccuracies, or system limitations. Jett Auction makes no guarantees or representations regarding the accuracy, completeness, or reliability of vehicle information. It is the Buyer’s sole responsibility to independently review the full CARFAX report and verify all vehicle details prior to placing a bid. Misrepresentation, omission, listing errors, or automated data inaccuracies do not constitute grounds for cancellation or withdrawal from a binding bid. Buyers assume full responsibility for: Bids placed from their account. Bids placed from their electronic devices. Bids placed by children, pets, or any other individual using their device.

Arbitration Policy

Arbitration is a formal, written dispute process strictly limited to undisclosed, verified catastrophic engine or transmission failures and qualifying undisclosed structural damage exceeding $1,500 in parts (labor excluded) and confirmed by an approved licensed facility within the stated deadline, it is not a tool for buyer’s remorse, price renegotiation, routine maintenance, or dissatisfaction with a competitive bidding outcome, vehicles sold for $5,000 or less, vehicles with more than 200,000 km, and vehicles sold as Tow Units do not qualify for arbitration under any circumstances, all vehicles are sold as is where is with all faults, bidders assume the inherent risks associated with purchasing used vehicles at auction, and all arbitration claims must be submitted exclusively through the “Make an Arbitration Claim” form located at the bottom of the Jett Auction website as phone calls, voicemails, or emails do not constitute submission of a claim and will not preserve or establish the official filing date or time.

Bidding & Payment Terms

The highest bidder becomes the purchaser. Bids are irrevocable. A non-refundable down payment is required immediately: $500 for purchases under $5,000 $1,000 for purchases over $5,000 Full payment must be received by 4:00 PM Tuesday following the auction. Failure to complete payment may result in: Forfeiture of deposit Forfeiture of item $250 late payment fee Legal action

Purchaser Identity, Pickup & Registration Requirements

The individual or entity registered as the bidder on Live Auction World (or any approved auction platform) is the legal purchaser of record and must be present in person at the time of pickup with valid government-issued identification. The Bill of Sale will be issued strictly in the name of the registered bidder. No substitutions, transfers, reassignment, or replacement of the registered purchaser will be permitted after the auction closes. The vehicle registration must be completed in the name of the registered bidder. Jett Auction does not permit third-party registrations, nominee purchasers, or reassignment of ownership at pickup. No third-party pickups are permitted under any circumstances. If the registered bidder requests to add a co-buyer to the legally binding sale documents after the auction has closed, a non-negotiable administrative fee of $199 will apply. The addition of a co-buyer does not replace or remove the original registered bidder from the Bill of Sale or transaction documents. Failure to comply with these requirements may result in: • A $199 administrative fee • Suspension of bidding privileges By registering, bidding, and accepting these Terms of Service, you acknowledge and agree that you fully understand and accept these identity, pickup, and registration

Limitation of Liability

Participation in any auction is at the bidder’s sole risk. To the fullest extent permitted by law, Jett Auction shall not be liable for any errors, omissions, data inaccuracies, technical issues, bid errors, listing inaccuracies, system interruptions, third-party reporting errors, or losses arising from failure to inspect or review policies. In no event shall Jett Auction be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of business opportunity, loss of use, transportation costs, storage fees, financing costs, regulatory penalties, or third-party claims. To the fullest extent permitted by law, Jett Auction’s total cumulative liability arising out of or relating to any auction, vehicle, listing, or transaction shall not exceed the total auction fees paid to Jett Auction for the specific transaction in question.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada. Any dispute, claim, or proceeding arising out of or relating to these Terms, any auction, vehicle, or transaction shall be brought exclusively in the courts of the Province of British Columbia, and the parties irrevocably submit to the jurisdiction of those courts.

Modifications

Jett Auction reserves the right to modify its policies, fees, procedures, and Terms of Service at any time. Any modifications shall apply prospectively to future auctions and transactions. Notice of material changes may be provided by posting updated Terms on the Jett Auction website. Continued registration, bidding, or participation in any auction after such updates constitutes acceptance of the revised Terms.

Dispute and charge back Policy

Buyer agrees that all sales are final and binding and that vehicles are sold as is, where is, with all faults. Buyer agrees not to initiate a credit card chargeback or payment dispute for reasons including but not limited to “merchandise not as described,” “defective merchandise,” “fraudulent transaction,” or similar claims once the vehicle has been paid for and/or taken possession of. Buyer agrees that any dispute regarding a vehicle or transaction must be addressed exclusively through Jett Auction’s published Arbitration Policy or by contacting sales@jettauction.com in good faith prior to initiating any payment dispute. Buyer acknowledges that initiating a chargeback or payment reversal in violation of these Terms constitutes a breach of contract and may result in: • Immediate suspension of bidding privileges • Legal action to recover damages • Recovery of the original transaction amount • Recovery of chargeback fees, merchant processing fees, administrative costs, and reasonable legal fees incurred in responding to the dispute Buyer authorizes Jett Auction to provide these Terms of Service, transaction records, vehicle listings, signed acknowledgments, and related documentation to the card issuer or financial institution in defense of any chargeback or dispute.
